General Terms and Conditions

This English version is a translation for your convenience. The German version is legally binding.

1. Scope

  1. These terms apply to all contracts between Sophie Simon, Scoottec, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany (hereinafter “I”) and my customers (hereinafter “you”) for lettering, scooter tags and spare parts ordered via scoottec.de, by email or in person.
  2. A consumer is any natural person who concludes a contract predominantly for private purposes (§ 13 BGB). A trader is anyone acting in the exercise of their commercial or self-employed professional activity (§ 14 BGB). Provisions that apply only to traders are marked as such.
  3. Deviating terms of the customer only apply if I expressly agree to them in text form.

2. Conclusion of contract

  1. The presentation of products on the website and in the configurator is not a binding offer but an invitation to order.
  2. Ordering via the website (lettering and scooter tags): you design your lettering or scooter tag in the configurator (the scooter tag in the Rollerpass, where your scooter’s number is fixed), click “Continue to order”, check your selection and the total price there and add your details. By clicking “Place binding order” you make a binding offer to buy the products listed there. I confirm receipt of your order by email without delay; this acknowledgement of receipt is not yet an acceptance.
  3. The contract is concluded when I accept your order by email (order confirmation with invoice). I accept or decline orders within 3 working days, e.g. if clause 2.7 applies. If you don’t receive an order confirmation within this period, you are no longer bound by your order.
  4. Inquiry: via the inquiry form or by email you make a non-binding inquiry (e.g. for special colours and spare parts). I then send you an offer; the contract is concluded when you confirm it by email or pay the invoice amount.
  5. You can correct input errors at any time before sending: in the configurator and on the “Check order” page, also via the link back to the configurator. After sending, a short message to hallo@scoottec.de is enough as long as I haven’t accepted the order yet.
  6. The contract languages are German and English. This English version of the terms is a translation; the German version is authoritative. You receive the contract text (your order data in the acknowledgement of receipt or my offer, the order confirmation and these terms) by email; I store it as part of the statutory retention obligations.
  7. I may decline orders, in particular if texts or templates could infringe third-party rights or a part is safety-relevant (clause 6).

3. Prices and payment

  1. All prices are final prices. In accordance with § 19 UStG no VAT is charged (small business regulation). For lettering and scooter tags, shipping within Germany is included in the price. For deliveries to other countries I calculate the shipping costs on request and tell you before the order confirmation; they are added to the displayed price. For spare parts, the offer shows the shipping costs.
  2. Payment is made by bank transfer against invoice (prepayment) within 7 days of the order confirmation or acceptance of my offer. I start production once payment has been received.
  3. You redeem discount codes on the “Check order” page; the discount is deducted from the total price immediately. One code can be redeemed per order; cash payment or subsequent crediting is not possible. Personal thank-you codes can only be redeemed once. Validity and conditions are stated with the respective code.
  4. Founder discount scooter tag: for scooters with Rollerpass numbers 1–100, a founder discount is automatically deducted from the first scooter tag order per scooter if the order is placed within the period shown for the scooter. Amount and period are shown in the configurator and on the “Check order” page. The founder discount cannot be combined with discount codes, except with promo codes that are expressly accepted as combinable on the “Check order” page; declined or cancelled orders do not use it up.

4. Lettering

  1. I make lettering according to your design in the configurator (text, font, size, colours). You are responsible for the correctness of the text and spelling. The preview shows shape and dimensions true to scale; colours may differ slightly from the filament depending on the screen.
  2. The fonts are my own or freely licensed fonts. I don’t reproduce original lettering or logos of manufacturers.
  3. Production-related characteristics of 3D printing (fine layer lines, slight differences in gloss and colour between material batches, dimensional tolerances in the tenth-of-a-millimetre range) are not a defect as long as the agreed use is not impaired.
  4. Proper installation according to the enclosed instructions is a prerequisite for the durability of the adhesive bond (clean, grease-free surface, application at at least 15 °C).

5. Spare parts

  1. Spare parts are replicas that I redesign on the basis of your photos, dimensions or a sample sent in. They are not original parts. I use manufacturer and model names only to indicate the fit.
  2. The accuracy of fit depends on your information or the sample. If deviations are due to incorrect or incomplete information, this is not a defect; a new production is then subject to a charge. On request I make a test part in advance at the agreed price.
  3. I return samples sent in together with the finished part. You bear the costs and risk of sending the sample to me.
  4. The designs and print files I create remain my property; there is no entitlement to the files.

6. No safety-relevant parts, installation

  1. I don’t make safety-relevant parts, in particular no parts of brakes, steering, chassis, throttle and brake controls, no load-bearing parts, no parts for fuel or oil lines under pressure or heat and no parts requiring a test mark such as lighting, reflectors or mirrors.
  2. Installation is carried out by you or a workshop of your choice. You are responsible for using the part only as intended and for clarifying before installation whether it affects the type approval of your vehicle.

7. Third-party rights

You assure that you are entitled to use the texts, names and templates you send and that no third-party rights (e.g. trademark, name or copyright) are infringed as a result. If third parties assert claims against me because of this, you indemnify me against them including reasonable costs of legal defence, insofar as you are responsible for the infringement.

8. Delivery

  1. The delivery time is stated in the offer. I usually ship lettering within 3–4 working days for colours in stock, 7–10 working days for colours I need to order and 10–14 working days for special colours. I ship scooter tags within the period stated in the configurator and on the “Check order” page. The period begins on receipt of payment.
  2. I deliver free of shipping costs within Germany. Deliveries to other countries are possible; I calculate the shipping costs on request and tell you before the order confirmation.
  3. For traders only: the risk passes to you upon handover to the shipping company.

9. Right of withdrawal, no exchange

Lettering is made according to your individual design, scooter tags with your scooter’s number and link, spare parts according to your photos, dimensions or sample. For consumers there is no right of withdrawal for such custom-made goods (§ 312g para. 2 no. 1 BGB). Returns or exchanges because you don’t like the item and refunds of the purchase price are excluded in these cases.

For goods that are not made to your specifications, consumers have a statutory right of withdrawal; details in the withdrawal policy. Your statutory rights in the event of defects (clause 10) remain unaffected in any case.

10. Defects

  1. The statutory warranty rights apply. If goods are defective, you can first demand subsequent performance, i.e. repair or new production. If this fails or is unreasonable, you can withdraw from the contract or reduce the price; I then refund the corresponding amount.
  2. Please report defects and transport damage as soon as possible with a photo to hallo@scoottec.de. For consumers this has no effect on their statutory rights.
  3. For traders only: obvious defects must be reported in text form within 14 days of receipt; otherwise the goods are deemed approved in this respect. The limitation period for claims for defects is twelve months from delivery. This does not apply to claims for damages under clause 11 or in the case of fraudulent intent.

11. Liability

  1. I am liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee given.
  2. In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

12. Retention of title

The goods remain my property until paid in full.

13. Dispute resolution

I am neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence.
  2. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the location of my registered office.
  3. Should a provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
